The Supreme Court has refused to conduct the NEET 2021 re-exam, setting aside the Bombay High Court’s decision. The Supreme Court said that the NEET UG exam of only two students cannot be conducted again. However, the court admits that a mistake has been made and feels sorry for the students, but it is not possible to conduct the re-examination.

In fact, the Supreme Court rejected the order of the Bombay High Court in which the High Court had ordered the re-examination of two students. The Supreme Court said that we are sympathetic to the students, but it is difficult to order for the re-exam, the National Testing Agency had knocked the door of the Supreme Court against the order of the High Court. The Supreme Court accepted the NTA’s application and set aside the High Court’s order.

The High Court in its order had said that the NTA should conduct the examination of two students again as the test book and OMR seat were mixed due to the mistake of the invigilator. The decision of the High Court was challenged by filing an application on behalf of the NTA in the Supreme Court. The Solicitor General argued on behalf of NTA that 16 lakh students across the country are sitting in the NEET UG exam, the exam has been held across the country and in such a situation, if some mistake happens and the re-exam continues, then this process will never be able to end.

The Supreme Court said that the NTA has suggested the calculation and computation of numbers before the High Court. A bench headed by Justice LN Rao said that he has sympathy for the student. The invigilator has admitted the mistake. We accept the appeal of NTA and set aside the order of the High Court. It was told on behalf of the students that due to the mix-up, the students were tensed during the paper. The court said that we are sympathetic to this situation. The Solicitor General had argued that there was a mix-up of 6 students but only two students applied. 16 lakh students have given papers and if the re-exams keep happening then this process will become endless. The Supreme Court set aside the High Court’s decision.
